Lawyers for Minority Leader Alexander Afenyo-Markin say they will pursue his GH¢15 million defamation case against Ghana Gold Board (GoldBod) Chief Executive Officer Sammy Gyamfi despite a High Court decision to strike out the suit over procedural defects.
The legal team insists the dispute will not end with the court’s ruling and says it intends to take the necessary steps to bring the matter to its logical conclusion.
The court set aside the writ of summons and statement of claim on Wednesday, October 14, 2026, after finding that the writ did not provide sufficient particulars of the publication alleged to be defamatory, as required under the High Court (Civil Procedure) Rules, 2004 (C.I. 47).
Mr Afenyo-Markin’s lawyers have criticised the procedural objections raised by Mr Gyamfi’s legal team, arguing that the focus should be on addressing the substance of the allegations rather than technical issues surrounding the court documents.
The suit stems from comments allegedly made by Mr Gyamfi during a public discussion concerning the Bank of Ghana’s Domestic Gold Purchase Programme and reported financial losses associated with the initiative.
Mr Afenyo-Markin maintains that the statements damaged his reputation and is seeking GH¢15 million in compensation.
The legal team’s position signals that it may consider fresh proceedings or other lawful options to continue the case, subject to the applicable court rules.
The court’s decision was based on the procedural validity of the writ and did not determine whether the statements at the centre of the dispute were defamatory.
